What is the process for a Live Local Act project in Marion County?

14 calendar days | 2. CS then reviews the application and either an approval or denial letter is issued within 14 calendar days. | ||
3. If the applicant receives a Live Local Act Approval Letter from CS, a Land Use Restriction Agreement (LURA) will be drafted and submitted to the County’s Legal team on behalf of the development by CS. Once the document is approved by legal, the applicant will then need to sign the LURA as provided by CS. The applicant must sign this agreement before moving to step 4. |

4. The applicant will then submit their Major Site Plan or Improvement Plan application to the Office of the County Engineer (OCE) to initiate the development review process (follow the process outlined in the Land Development Code) by completing the application, linked here. The applicant should include their approval letter from CS and the signed LURA along with their application. Complete applications should be sent to: DevelopmentReview@marionfl.org For the purpose of expediting application approval and reducing the cost of development, applicants are encouraged to request a pre-application meeting with County staff to review the feasibility of the project and to obtain information and guidance from the County. 5. Once an application for development review is submitted, an application request (AR) number is created and emailed to the applicant along with confirmation of receipt and instructions for how to log in to ePlans. The applicant should find the documents from Step 4 have been uploaded to ePlans upon logging in. The applicant will be responsible for uploading the site plan and any other necessary information found in the Application Requirements table (found in the Land Development Code section 2.11.1.) under “Major Site Plan” or “Improvement Plan”. |

6. Once the applicant task has been completed, the project will be routed electronically for review and departments will either approve, approve with conditions or deny with comments. Throughout the review, the applicant shall follow the process as outlined in the Land Development Code including requesting waivers. |

7. If a department provides comments to be addressed, the applicant is expected to stay in communication with these departments to address the comments provided. Once corrected documentation is provided, the project is rerouted for review. |

8. Once staff comments have been satisfactorily addressed, the project is added to the next available Development Review Committee (DRC) agenda. The applicant is expected to attend these meetings. Applicants will be required to provide one set of signed and sealed stamped plans to OCE in order to receive a development order and begin construction. As-builts are required upon site completion and prior to Building Safety issuing a certificate of occupancy (CO). |

9. Once the project completes the DRC process, CS will have the LURA signed by the county and recorded at the Marion County Clerk of the Courts, at the applicant’s expense. A recorded copy will be provided to the applicant. |

10. After the LURA is recorded and a copy is given to the applicant, the applicant will then need to apply for a building permit with the Building Safety department by completing the application, linked here. Permits for Live Local applicants will be expedited by the Building Safety department staff. |

11. The applicant will notify the CS Project Coordinator when final inspections are ready to be scheduled for a final walk-through and punch list prior to CO. |

12. The applicant will notify CS when the project has been completed and a CO is issued. |

13. CS will begin monitoring the project for compliance with the LURA. Failure to notify CS that the development is occupied within 60 days may result in non-compliance and additional fees. |
